Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Persona Bakery website and application (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
1. Service Provider

Persona Bakery and The Private Pantry are trade names used by the service provider. In these Terms, "we", "us", and "our" refer to the provider above.
2. Scope and related policies
These Terms apply to the Service and incorporate by reference our Privacy Policy, Cookie Policy and Ethics Policy. By using the Service, you agree to comply with these policies.
3. Eligibility and accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You agree to provide accurate information and keep your account details current.
- You are responsible for safeguarding your login credentials.
- You are responsible for all activity under your account.
- You must notify us promptly of any unauthorized use of your account.
4. The Service and acceptable use
The Service provides AI-assisted tools for creating and managing virtual personas and generating content. You must use the Service lawfully and in line with the Ethics Policy.
- Do not generate or upload illegal, abusive, or harmful content.
- Do not create content involving minors or non-consensual sexual imagery.
- Do not imitate real people without explicit, documented consent.
- Do not infringe intellectual property or privacy rights of others.
- Do not reverse engineer, disrupt, or bypass security measures.
- Do not use automation to spam or violate third-party platform rules.
We may remove content or suspend accounts that violate these Terms, the Ethics Policy, or applicable law.
5. User content and license
You retain any rights you have in the content you submit to the Service. You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your content and generated outputs solely to provide and improve the Service, to comply with legal obligations, and to enforce these Terms.
You represent that you have all rights necessary to submit the content and grant the above license. You are responsible for your content and for ensuring it complies with law and these Terms.
If you are a business user, you agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising out of your content or your violation of these Terms.
6. AI outputs
AI-generated outputs may be inaccurate or unsuitable for your intended use. You are responsible for reviewing and using outputs in compliance with applicable law and platform rules. We do not guarantee any specific outcomes, reach, or financial results.
7. Third-party services
If you connect the Service to third-party platforms (such as social networks), your use of those platforms is subject to their terms and policies. We are not responsible for third-party services or their actions.
8. Fees, billing, and refunds
The Service is provided under a monthly membership model. The current membership price, billing cycle, and applicable taxes are shown at checkout and may change with reasonable prior notice.
- Monthly membership includes access to the Service and 100 credits per monthly billing period.
- Credits are spent when generating posts or using other credit-based generation features in the Service.
- Additional credits may be purchased at any time through separate top-up payments.
- Credit usage is tracked and made available to the user as spend history in the admin area.
- Membership renews automatically until canceled.
- All payments and invoices are processed through Stripe. We rely on Stripe for payment transaction processing and invoice delivery.
- You are responsible for all fees and applicable taxes.
- Refunds are provided only where required by law.
If you are a consumer in the EEA and purchase digital content or a digital service, you may be asked to expressly request immediate performance and acknowledge that your right of withdrawal may be lost once performance begins, as required by law.
9. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, the Ethics Policy, or applicable law, or if necessary to protect the Service or other users. Termination does not affect accrued payment obligations.
10. Warranties and liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, loss of profits, or loss of data. Nothing in these Terms limits liability for intent, gross negligence, death, personal injury, or other liability that cannot be excluded under Czech law.
If you are a business user, our total liability arising out of or related to the Service is limited to the fees you paid for the Service in the 12 months preceding the event giving rise to the claim.
11. Privacy and cookies
We process personal data in accordance with our Privacy Policy. Cookies and similar technologies are described in our Cookie Policy.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on the website, with the effective date indicated above.
13. Governing law and dispute resolution
These Terms are governed by the laws of the Czech Republic. If you are a consumer, you may also have the right to bring claims in your local courts and to use alternative dispute resolution.
Nothing in these Terms limits mandatory consumer rights under Czech law.
The Czech Trade Inspection Authority (Česká obchodní inspekce) provides ADR for consumer disputes. The EU online dispute resolution platform is available at https://ec.europa.eu/consumers/odr.
